EDWARDSVILLE — A few years ago, Jason Peipert of Godfrey had a college soccer scholarship, was almost out of his teens and wanted to shed that last vestige of youth — embarrassing acne. The Madison County trial, which Circuit Judge David Hylla has set for October, will likely be watched around the country and could serve as a bellwether for hundreds of other suits. One key unanswered question is whether Hylla will allow Peipert’s attorneys to pursue punitive damages; a potentially large additional award if a jury finds wanton misconduct, gross negligence and fraud in Hoffman-La Roche’s actions. Peipert’s attorneys and others around the country say Hoffman-La Roche actively played down Accutane’s risk for inflammatory bowel disease, a catch-all term for a number of health problems, including ulcerative colitis and Crohn’s disease. read more
